One clause needs your attention. Article 8.3 gives every partner a royalty-free licence to all background IP. The Horizon Europe rules only require access to the background a partner needs for the action.
Articles 11.2 and 14.1 match the rules as written.

Searches go to Staan, a European search engine run by European Search Perspective SAS in Paris. Google is used only after you switch it on and confirm.

Common questions
Where does my data go?
From your browser to our servers in a Hetzner data centre in Germany. From there to CORTECS (Cortecs GmbH, Vienna), the EU gateway that passes your message to the company serving the model. That company is established in the EU, and your message and the technical data around it are processed in the EEA. If no such company can serve the model, the request fails instead of going elsewhere.
What does “zero data retention” mean?
The company that runs the model keeps no copy of your message. It may not store it, log it or train on it, and this is written into a data-processing agreement. We request it on every message, and no setting can switch it off. If a model cannot run this way, the request is refused and you are told, so you can pick another model.
What is the difference between zero data retention and Ephemeral?
Zero data retention is about the AI provider. It keeps nothing of your messages, and it is always on. Ephemeral is about us, and you choose it for each chat. By default we save your chats so you have a history, each until 90 days after its last message or the period you choose. An Ephemeral chat is never stored: no messages, no title, no files.
Can anything ever leave the EU?
Only one thing, and only if you ask for it: Google web search. It is off by default and works only with Gemini models. It is not available in Ephemeral chats, and it asks you to confirm a notice for that chat. When it is used, the search words for that answer go to Google in the United States. The answer is then marked in red: Left Europe. Everything else in your chats stays in Europe: the model, the European web search and your documents.
Can you read my chats?
Technically yes, as with any service that stores your data. We store your chats in Germany so you can return to them. We do not read them for product, marketing or training purposes. Access is limited to running and supporting the service, and it is logged. An Ephemeral chat is never stored, so we have no copy of it to read.
Is EurekaGPT GDPR compliant?
We build EurekaGPT to be GDPR-compliant by design, and we show how. Each principle and the measure behind it is listed on the Trust page, and a data-processing agreement is available on request. We do not claim a certification we do not have. Compliance also depends on how a system is used, so we publish the measures for you to check.
